July 2024 JPPC Appeal Success- dog exercise field

JPPC have been successful at appeal securing permission for a new dog exercise field in the Vale of White Horse District, Oxfordshire for a private client.

The Council previously refused planning permission as they considered the provision of the new leisure facility in a rural area contrary to its Local Plan policy.  However, JPPC successfully argued at appeal that the proposed facility, as diversification of an existing rural business, was supported by provisions of the Development Plan and NPPF that strive for a prosperous rural economy.  Furthermore, the development was aligned with the Development Plan for the area when the document was considered as a whole.

The Inspector concurred with JPPC’s position concluding that, notwithstanding the Local Plan’s preference for new leisure facilities to be located in accessible locations, the proposed facility was beneficial to the rural economy and compliant with the Development Plan when read as a whole.  They therefore allowed planning permission overturning the Council’s refusal.
